1. Terms of Service

These terms and conditions govern your access to and use of the Services (listed below) and any information, text, copy, illustrations, videos and all other material rendered on site. Your use and access to these services is conditioned by your compliance to these Terms. Certain content and or services may be subject to additional rules and guidelines, therefore by accessing and using these services you agree to be bound by these Terms.

2. Use of Services

CookHalaal is a portal where Registered Users can write, contribute and edit their content through the Services. CookHalaal is a collaborative space where users can share useful and interesting information about food.

Services may include advertisements, which may be targeted to the content or information on the Services, queries made through the services, or other information. The range and types of advertising on the Services are subject to change without prior notification in consideration for CookHalaal granting you to use and access the Services. CookHalaal and its providers may place such advertising on the Services or in connection with the display of content or information from the Services whether submitted by you or others.

3. License to the Services

Subject to your compliance with these Terms, CookHalaal grants you a non-exclusive and non-transferable single user license to access the site and services thereof on your computer and/or mobile device, and to access and use the Services solely for your own personal use. You may not copy, modify or distribute the Application for any purpose, transfer/sublicense lease, lend, rent or distribute the Services to any third party. You are not allowed to decompile or create derivative works of the Services or make the functionality of the Services available to multiple users through any means.

4. Account Registration

In order to access, use or receive Services you need to register and create and account. To become a registered user, you may either register on our site or application or by using your account with a third party social network website, eg Facebook and Google Plus. In creating an account, you agree that you are of a legal age within your country of legal and permanent residence to enter into a binding contract. When creating an account, you will be required to provide certain personal information about yourself and create a username and password.
We reserve the right to suspend or terminate your account if any information provided during or post the registration process proves to be inaccurate, fraudulent or misleading.

5. Fees and Payment

The current version of Cook Halaal is a free use site, CookHalaal reserves the right to change this model which will be communicated to users in the agreed upon manner. Note that any fees exclude charges by your mobile or internet provider, this includes data and messaging plans.

6. Content on the Services

CookHalaal is a portal where Registered Users can write, contribute and edit Content through the Services. CookHalaal is a collaborative space where users can share useful and interesting information about food. CookHalaal is not responsible for screening and/or verifying that the information provided through the Services and we cannot guarantee that the information provided is accurate, reliable, complete and safe to practice. Users are encouraged to familiarize themselves with the conditions as determined in clause 12: Third Party Services of the Terms and Conditions.

7. Submitted Content

By submitting, uploading or otherwise transmitting Content through the Services, you grant CookHalaal non-exclusive, royalty-free license of all your content. CookHalaal has the right to transfer, sublicense, store, use, copy, modify, adapt, distribute, sell, publicly display, create derivative, transmit, stream, broadcast, and otherwise fully exploit said content. CookHalaal also has the right to incorporate such content in other works, any form, technology or media for operational purposes of providing, improving and promoting Services. You agree that this licence includes the rights of other CookHalaal users of the Services to access, view, download and print any content for their personal use and non-commercial purposes.

You retain full ownership of any content you post, submit and display through the Services, CookHalaal does not claim ownership rights of the content provided by yourself. You are solely responsible for your use of the Services and any content you provide and any consequences thereof, including the use of your content by other users. You represent and warrant that you have all the rights and authority necessary to grant the rights granted herein to any content you provided. CookHalaal reserves the right at all times to remove or refuse to distribute any content you may provide through the Services that violates these Terms.

8. Ratings and Reviews

Ratings and reviews posted by Users on our Services are User Content that is not endorsed by CookHalaal and does not represent the views of CookHalaal. CookHalaal does not assume liability for ratings and reviews or for any claims for economic loss resulting from such ratings and reviews. Because we expect Users to maintain a high level of integrity with respect to ratings and reviews posted through the Services, you agree: (i) to base any rating or review you post only on your first-hand experience with the applicable business, product, or
service; (ii) you will not provide a rating or review for any business, product, or service with respect to which you have a competitive, ownership or other economic interest, employment relationship or other affiliation; (iii) you will not submit a rating or review in exchange for payment or other benefits from any individual or entity; and (iv) your review will comply with the terms of this Agreement. If we determine, in our sole discretion, that any rating or review could diminish the integrity of the ratings and reviews, we may exclude such User Content without notice.

9. Copyright Policy

We at CookHalaal respect the property of all users and expect the same from our users. If you feel that your work has been copied and reposted on our Services, you will need to supply us with detail of the copyrighted work that you claim has been infringed as well as where on the Services this has been posted. CookHalaal agrees to investigate any claims of copyright infringement and further reserves the right to remove any content in violation of this policy without prior notification and may also terminate your account if you are proven to be a repeat offender of copyright infringement.

10. Third Party Services

CookHalaal Services will contain links to third party websites and services provided by third parties. We will not be held responsible or liable for the inaccuracy and or availability of such services, or the information, products and services available through third parties. You are solely responsible for all risk taken from your use of any third party services. CookHalaal carefully curates content from third parties and bloggers with their express consent. CookHalaal does not guarantee the content hosted on third party sites and blogger is aligned towards the ethics and views of CookHalaal, users are required to agree and familiarize themselves with the relevant conditions of use for each site. CookHalaal does not endorse, approve or guarantee the information, recipes or products available on any external sites. use of any such linked websites is at the user’s own risk and responsibility.

11. General Prohibitions

You agree that you will not post content that a) is an advertisement of a product or service, b) is false, misleading, confusing and knowingly deceitful, c) promotes dangerous and illegal substances. You also agree not to do any of the following while using the services a) acquiring and using other users’ personal information available through the services to transmit unsolicited advertising and spam mail. b) attempt to access non-public areas of the services. c) use of services for commercial use or for the benefit of any third party. CookHalaal reserves the right to investigate or prosecute any violations of the above terms. You acknowledge that CookHalaal has no obligation to monitor your access of the Service, but has the right to do so for the purpose of operating the Service and ensure that you comply with these Terms.

12. Ownership

The Services are protected by copyright and trademark laws of South Africa. CookHalaal owns all rights, title and interest in and to the Services, including all associated intellectual property rights. You may not remove or alter any copyright trademark or any other proprietary rights notices incorporated in or accompanying the Services. You agree that any feedback, comments or suggestions you may provide regarding CookHalaal or its Services will be the exclusive property of CookHalaal and you irrevocably assign to CookHalaal all your rights, title and interest in and to all feedback services. Subject to your compliance with the terms and conditions of these Terms, CookHalaal grants you a limited, non-exclusive, non-transferable license without the right to sublicense, to access and use the Services and to download and print any content provided by CookHalaal solely for your personal and non-commercial purposes. You may not use copy, modify, adapt, distribute, license, sell, transfer, transmit or otherwise exploit the Services or Content, except as permitted in these Terms. No licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by CookHalaal or its licenses, except for the licences and rights expressly granted in these Terms.

13. Termination

You may terminate your Account at any time by deactivating your account or providing us with a notice of termination. CookHalaal reserves the right to suspend, terminate or disable your access to the use of the Services should you breach any of these Terms. CookHalaal will not be liable to you or any third party for termination of your access or use of the Services. Any suspension or termination will not affect your obligations to CookHalaal under these Terms, including ownership, confidentiality and limitation of liability.

14. Service availability

You understand and agree that the Services and Content and all information, products and services included therein are provided to you ‘AS-IS’ and on an ‘AS-IS Available’ bases. Without limiting the foregoing, CookHalaal disclaims all warranties of any kind, express, implied or statutory, relating to the Services and Application. Your use of the Services is at your sole discretion and risk, CookHalaal will not be responsible for any harm to your computer or mobile device, loss of data. CookHalaal makes no warranty that the Services will meet your requirements or be available on an error-free basis. CookHalaal makes no representation or warranty regarding the accuracy, timelines, completeness and integrity of the content provided through the Services, as well as any information, services promoted or displayed through the Services. The Content including the recipes and all related information and commentary made available through the Services is for informational purposes only and is not intended to be dietary advice or recommendations specifically for you and no advice or information, whether oral or written obtained from CookHalaal or the Services will create any warranty not expressly made herein. You are solely responsible for all your communications and interactions with other users of the Services and with other persons with you communicate as a result of your use of the Services.

15. Indemnity

You agree to defend, indemnify and hold Cook Halaal and its staff harmless from and against any claims, damages, liabilities, losses and expenses including without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or you violation of these Terms.

16. Limitation of Liability

The maximum extent permitted by applicable law, CookHalaal and its subsidiaries, officers, affiliates, partners and agents will not be held liable for any damages, including without limitation, loss of profits, data, use, any damages for personal or bodily injury arising out of or in connection with these terms. CookHalaal is not liable for any losses resulting from your access to or use of or inability to access or use the Services. As well as any conduct or content of any third party on the Services, including without limitation, defamatory, offensive or illegal conduct of other users or third parties, any content obtained from the Services. CookHalaal is not liable for any communication or interaction with other users of the Services or other persons with whom you communicate or interact as a result of your use of the Services, and unauthorised access, use or alteration of your transmissions or content, whether based on warranty, contract or any other legal theory, whether or not CookHalaal has been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

17. Exclusions

Certain jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages, therefore the above limitations may not apply to you.


These terms are governed by legal law, therefore these Terms and our Privacy Policy are the entire and exclusive agreement between CookHalaal and yourself regarding the Services, and these Terms supersede and replace any prior agreement between CookHalaal and you regarding the Services. These Terms may be revised from time to time, and CookHalaal will endeavour to provide at least 30 days’ notice prior to any new terms taking effect. You agree to be bound by these Terms if you continue to make use of and access the Services. It is recorded and agreed upon that the onus remains with the user to ensure that they are familiar and in agreement with any and all updates to said policies, regardless of receiving notification of change.
